Property Law

We specialise in various types of property related transfers namely property transfers, estate transfers, servitude registration. The transfer process is as follows:

  • Signature of the Deed of Sale drafted by either an Estate Agent, Law Firm or by both the seller and purchaser;
  • The seller or Estate Agent sends the signed deed of sale to the transferring Attorney to proceed with the registration;
  • Seller and Purchaser to provide the transferring Attorney with FICA documents ( ID copies, Income Tax Statement, Proof of Residential Address, Trust Deed );
  • Signing of Transfer Documents;
  • The transferring Attorney will request the cancellation figures from the financial institution ( bank ). After same has been received, the transferring Attorney will work hand in hand with the bond Attorney to request guarantees;
  • The transferring Attorney will request rates clearance figures from the relevant Municipality on behalf of the seller as well as levies from the relevant body corporate or home owners association;
  • Transfer duty to be submitted at SARS in order to obtain a receipt or exemption certificate;
  • The seller is then obliged to provide the purchaser with a certifcate of compliance in respect of the electricity on the property to insure that it is safe to use prior to the registration;
  • Lodgement at the Deeds Offce;
  • Transfer documents are then to be checked by 3 examiners in order to ensure that all the documents are in order;
  • Transfer to be registered and the seller will receive the balance of the purchase price and the estate agent’s commission to be paid.
